Information from Attorney Casey Gray

Attached is a letter from Attorney Casey Gray.  As the HOA receives  information that may be of benefit to the members we are trying to help pass that information along.  Mr. Gray is one of three attorneys that are assisting some of the residents.  Though the HOA itself has not retained counsel in this matter, we recognize that this information can be beneficial to all homeowner's.  

SilverHawk HOA does not endorse any specific attorney or course of action regarding this information.

Why is there a place to write comments when the HOA erases all of them. Can this attorney help us with our elected reps turned dictators?

The HOA can help you with legitimate matters. However, you must be a property owner in SilverHawk with legitimate business. As you are probably aware and according to our records and County records, you currently do not own any property in either SilverHawk or Oklahoma County. Perhaps an error was made and you could clear this up for us. If you want to speak on the phone I’d be happy to. My phone number is 412-5718.

You don’t have to own property to live here Chris, but good job doing an internet search. Sorry you forgot about renting there for a minute. I’ve been discriminated against and shut down due to your personal distaste for animals. How about an open discussion on it without erasing comments? I’ve been giving my animals a swim in that pool for years and they do get filthy but that’s more the reason to let them have a go in there.

Blogs are often subject to spam posts. Those types of posts have no place on a forum that is that was built for the purpose of disseminating information to our Members. In general we try not to interfere in discussions. Based on the little information we had about you at the time and the statements you made on the site, we made an assumption that you were a spammer. So, now that we have cleared that up, I think we can continue to have some dialogue.

I would like to clarify something though. There is no discrimination against you. Discrimination would suggest that you have been denied a right that you are entitled to by law. This is not the case. As a renter in SilverHawk the rights that Members have do not extend to tenants. Though we do welcome and encourage dialogue with all neighbors whether homeowner or renter. The issue was that your posts seemed inflammatory and aimed at causing strife instead of engaging in respectful conversation or at least trying to figure out why we have such a rule in the first place. Additionally, we did not find you in any of our records and therefore assumed that you were a spammer.

SilverHawk does reserve its right to moderate the blog even with Member postings. However, we almost never do unless it appears to be abusive or if it appears that the comments are spam. The Board speaks and make a joint decision before we do so.

Now, more to the whole point of the conversation. This Association was formed under Oklahoma General Corporation Act and operates under those statutes, our Certificate of Incorporation, our Declaration and Bylaws. In addition, the Association has the authority to create rules that all neighbors must follow concerning the common areas including the pool. Failure to abide by those rules carry consequences such as fines and forfeiture of the use the common areas. These rules, such as no pets in the pool area, were not created arbitrarily or to discriminate. In fact, the HOA included them in the rules to match the regulatory requirements of the State Health Department that require the pool operator to “[s]ee that animals are not allowed inside the pool enclosure.” (310:320-3-2(d)(1)(j)). If a pet is found to be in the pool, we are required to immediately shut down the pool and treat the water. This costs the Association money and negativity impacts the rest of the Members by losing a day using the pool.

Now that we know you have come to this seriously, we want you to know that we acknowledge you and we understand that you are serious about wanting to bring your pet to our pool. But we also must let you know that this is absolutely not allowed per our rules and health department code.

I do hope that this helps you understand the rules of the Association and gives you the level of dialogue you were hoping for.

That pool has chlorine in it. The second the germ molecules touch the chlorine molecules, the germ is dead instantly. That’s simple science.

On top of that, my animals are no worse than the humans I see swimming in it. People spit water out of their mouths every time they come up for air. That’s disgusting. This is the same water that touches every part of everyone’s body.... even the gross parts we don’t want to think of. But it’s all good because the germs are dead.

In summary, my animals love to swim. The germs are dead. Science. And whatever debris or fur may come from the animals is prob collected by some filter or sucked up by a vacuum.

As a homeowner and pet lover, I can say that I absolutely do not want pets in the pool. I 100% agree with the rule. And I’m not certain but can ask around, this rule is standard for every public pool.
