HOA Board Meeting June 18

Our next HOA Board Meeting will be Tuesday, June 18th, 7pm at the Clubhouse. Regular business and damage from car accidents will be the main topics of conversation. The full agenda can be found on the Meeting Agenda page. Contact the Secretary if you have additional items to discuss.

Hello,
I’m at 17601 Black Hawk Drive and was wondering if the overgrowth addressed in the last meeting included the homes on Black Hawk Drive that have weeds growing over our fences?
I didn’t see any meeting minutes so I wanted to follow up.

Hi Jen,

According to the Covenants, the growth between your fence and the drainage ditch is the lot owners' responsibility:

"All small drainage channels, emergency overflow and other swales which are important to abutting properties but are not a part of the drainage system maintained by public authority
or utility company, shall be the Owner's responsibility; and it shall be the responsibility of the Owner to (a) keep the easements, channels and swales free ofany structure, planting or other material which may change the direction of flow or obstruct or retard the flow of water in the channels or swales, whether they be in easements or contained on the individual Owner‘s Lot, and (b) the Owner shall provide continuous maintenance of the improvements in the easements, or of the channels or swales; except for the improvements for which a public authority, utility company or Association is responsible."

The east side of that drainage ditch has never been maintained by the HOA and has never been included on the plats we give to the landscaper for maintenance. We did discuss giving the Lot owners the option to pay for the HOA landscaper to clear out the growth behind the fences if the landscaper can get to it, but we're waiting to hear from the landscaper whether they can even reach that area. There's nothing we can do about it if the fencing along the ditch is too close to the ditch for a worker to get in.

That is good information to have. I only asked because the first 3 years it was taken care of and I now couldn’t get to the back of my fence due to other property owners’ overgrowth I’d I tried.
I’d be happy to pay for behind my house. Thank you for your reply.
